Wedding Contract

This contract must be printed, signed and returned with your “Wedding Information” sheet and your retainer. That will get you on our calendar! We want to be your Jackson Hole photographer!

TERMS AND PROVISIONS

 

 1.  All photographic materials (digital files, negatives, transparencies, etc.) shall remain the sole and exclusive property of Swope’s Mountain Photography, LLC.  The client shall be permitted the right to order prints and use such materials at the agreed-to prevailing rates.  Swope’s Mountain Photography, LLC owns all copyrights.  This contract assigns no usage or reproduction rights.

 

 2. There shall be no refund of deposits or retainers paid if the event is canceled in any way.  The full and complete sum shall be deemed due two weeks before the event, notwithstanding subsequent selection of prints. If the client fails to make whatever payments are required under this agreement, then all obligations of Swope’s Mountain Photography, LLC shall cease without any further obligations thereto the ordering party.

 

3.  With respect to all payments there under, a service charge of 2.5% per month on any unpaid balance shall be charged.  If collection is necessary, the client shall be solely responsible for all collection costs, including reasonable counsel fees.  Time is deemed of the essence with respect to all payments there under.

 

4.  In the unlikely event that the photographer is injured or becomes too ill to photograph the event, Swope’s Mountain Photography will make every effort to secure a replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package. There shall be no liability on behalf of Swope’s Mountain Photography, LLC, it’s employees, agents, assigns or licensees for their nonperformance caused by any force majeure or similar circumstances, illness, accident or any cause beyond their control; nor for the loss or damage of any photographic materials, whether in transit or in processing.  In any event, the limit of Swope’s Mountain Photography, LLC's liability shall not exceed the contract price stated herein.

 

5.  Swope’s Mountain Photography, LLC shall deliver physical proofs or online proofs to the client in accordance with those standards reasonably deemed acceptable throughout the industry.  Failure of the client to object in writing to the proofs within ten (10) days after receipt shall constitute a waiver.  Acceptance of prints, transparencies or albums shall be deemed a release of all claims against Swope’s Mountain Photography, LLC and their employee, agents, assigns, licensees or legal representatives.

 

6.  There are no oral or other agreements the parties hereto and this agreement constitutes full and complete agreement between the parties. Changes must be submitted in writing and signed by both parties.

 

7.  Swope’s Mountain Photography, LLC shall have the right to display or publish any of the photographs taken pursuant to this agreement & the client hereby agrees and consents to the same.  This agreement qualifies as a model and/or property release.

 

8.  There shall be no refunds of pre-paid credit or ala carte items. Substitutions are welcome.

 

9. Due to the uncontrollable nature of wedding logistics, photographing requests may be impossible. While every effort will be made, no requests are guaranteed and Swope’s Mountain Photography, LLC assumes no liability for omissions.

 

10. This agreement is not to be construed as an employment agreement in any way.  Swope’s Mountain Photography, LLC's function is that of an independent contractor.

 

11. This contract shall be governed by the laws of Wyoming. Any contract disputes will be settled in Small Claims Court in Jackson, Teton County, Wyoming.
